These Terms and Conditions govern your access to and use of this website, operated by Ravi Badalia Group, trading as Badalia Gems pvt Ltd , having its registered office at 22 Camac Street, Block A, 5th Floor,, Kolkata 700016, West Bengal , India.

By accessing or using this website, placing an order, or otherwise transacting with us, you agree to be bound by these Terms. If you do not agree, please do not use this site.

1. About Our Products

Badalia Gems designs and offers fine jewellery, including gold, diamond and gemstone pieces. Certain pieces are handcrafted to order and manufactured on receipt of an order, while others are available as ready stock.

As our jewellery is largely handcrafted, minor variations in weight, finish, stone placement and dimensions between the photograph and the delivered piece are natural and do not constitute a defect. Product images and descriptions are as accurate as we can make them, though actual colour and finish may vary slightly depending on your screen. Weight and dimensions are based on our manufacturing specifications and may vary within standard industry tolerance.

Natural gemstones and pearls may carry inclusions, colour variation or characteristics typical of natural stones.

Where applicable, gold jewellery sold on this site is hallmarked in line with Bureau of Indian Standards requirements, and diamond or gemstone certification, where provided, is specified in the product listing.

2. Pricing, Taxes and Payment

All prices on this site are in Indian Rupees and are exclusive of applicable GST unless stated otherwise. Prices of gold and diamond jewellery are linked to prevailing metal and stone rates and may change without prior notice. The price that applies to your order is the price confirmed at the time of purchase.

We accept payment via bank transfer. Full payment, or the applicable advance for custom orders, is required to confirm an order.

If a genuine pricing error appears on the site, we reserve the right to cancel the affected order and refund any amount paid.

3. Orders

Placing an order is an offer to purchase, which we may accept or decline, for example in cases of pricing errors, stock unavailability or suspected fraud. An order is confirmed only once we issue an order confirmation and receive the applicable payment. You are responsible for ensuring the details you provide, including delivery address, contact number and sizing or customisation instructions, are accurate.

4. Custom and Personalised Jewellery

Certain pieces are made to order based on your specifications, such as size, engraving, stone selection or design changes. Custom orders may be required as an advance at the time of booking, with the balance due before dispatch.

Because these pieces are made specifically for you, they are, apart from manufacturing defects, non-returnable and non-refundable once production has begun. Cancelling a custom order after production has started may attract a charge to cover material and labour already used.

5. Product Availability

Since much of our jewellery is manufactured at our own facility, an in-stock piece may still need [25-35 days] before it can be dispatched. If a piece you are interested in is on back order, please contact our customer care team for an estimated availability date. We reserve the right to limit quantities or decline an order where a product is unavailable, and will offer a refund, substitution or the option to wait.

6. Shipping and Delivery

Processing time, the time we take to prepare an order, is separate from transit time, the time our courier partner takes to deliver it. Estimated processing time is 7-10 working days. Given the value of our products, deliveries are made only to the address on the order, with a valid signature required on delivery. We are not responsible for delays caused by an incomplete or inaccurate address.

All shipments are insured for their full purchase value. Risk in the product passes to you once it is delivered and signed for at the specified address. Delivery timelines are estimates and may be affected by factors outside our control.

10. Warranty and Repairs

We warrant our products against defects in workmanship for 1 year from the date of delivery. If a genuine manufacturing defect is found within this period, we repair or replace the piece at no charge, subject to inspection.

This warranty does not cover normal wear and tear, accidental damage, improper storage or use, exposure to chemicals or moisture, loss or theft. Precious metals and stones naturally wear over time, and this is not a defect. Any repair, resizing or alteration carried out by a jeweller other than Badalia Gems voids this warranty.

This warranty is not an insurance policy. It is your responsibility to insure your jewellery against loss, theft or damage not covered here. Post warranty repairs, resizing and polishing are available through our in-house workshop at applicable charges.

11. Jewellery Care

We recommend storing your jewellery separately in a soft pouch, avoiding contact with perfume, chemicals and water where possible, and having it professionally cleaned and checked from time to time. Piece specific care guidance is provided at delivery.

12. Intellectual Property

All content on this site, including designs, images, logos, text, and the Badalia Gems and Ravi Badalia Group names and marks, is owned by or licensed to us and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not reproduce, distribute or use this content without our prior written consent.

13. Website Use

You agree to use this site only for lawful purposes and not to misuse it in a way that could damage or impair it, attempt unauthorised access to any part of it, or use automated means to extract data from it without permission.

14. Privacy

Our collection, use and disclosure of your personal data is governed by our Privacy Policy, and is handled in line with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000, as applicable.

15. Limitation of Liability

Our total liability arising from any order will not exceed the amount you paid for that product. We are not liable for indirect or consequential losses. Nothing in these Terms limits any liability that cannot be excluded under the Consumer Protection Act, 2019.

16. Force Majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, strikes, courier disruptions or government action.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of India, including the Indian Contract Act, 1872 and the Consumer Protection Act, 2019. Subject to your statutory right to approach the appropriate consumer forum, any disputes arising from these Terms are subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal.

18. Changes to These Terms

We may update these Terms from time to time. The updated version is posted on this page with a revised date, and applies to orders placed after that date.
